Dispute Resolution Process

As Zachry employees, each of us should value the performance and contribution of all employees. We strive to provide a productive workplace while sustaining a profitable company. Disputes in the workplace should be resolved quickly and fairly by employees and supervisors at the job site.

Zachry understands, however, that employees will sometimes have complaints or problems that cannot be easily resolved at the job site. The accumulation of unspoken, unanswered complaints can result in dissatisfaction and can undermine a successful working relationship. Workplace disputes can also be very costly and time-consuming for both the employee and the company.

Our goals are: (1) to prevent workplace problems and disputes from occurring, and (2) to promptly resolve workplace problems and disputes that do occur.

The DR Process has been developed by building on Zachry’s existing open communication program. The DR Process incorporates the current processes and adds steps to provide effective methods of resolving workplace disputes in a way that: (1) promotes open lines of communication; (2) reduces the delay, costs, and difficulty in problem solving; and (3) promotes “win-win” solutions.

Depending on the circumstances of an employee’s dispute, the DR Process provides up to five steps for resolving workplace disputes.  The first three steps (Internal Review) cover any workplace problems, including legally protected rights, while steps four and five (External Review) cover only disputes involving legally protected rights.

Zachry’s success is founded on the abilities, dedication and efforts of all employees. Zachry’s policy is to deal with employees responsibly and honestly and to respect and recognize each as an individual.  As soon as a dispute arises, an employee should discuss job-related disputes or concerns with his or her immediate supervisor. All employee questions and/or complaints will be taken seriously, including those alleging discrimination or harassment. Employees are encouraged to report violations of company policies without fear of retaliation. If the dispute is not resolved at the supervisor level, the employee may proceed to the next level of supervision. You are encouraged to follow the chain of command to the highest level necessary to resolve the dispute.
